Supreme Court to Hear 16 States’ Challenge on EFCC Establishment Act”

The Supreme Court has scheduled a hearing for October 22 to address a lawsuit filed by 16 state governments challenging the constitutionality of the Economic and Financial Crimes Commission (EFCC) Establishment Act.

The case, originally brought by the Kogi Government, questions whether the EFCC Act, passed in 2004, followed constitutional requirements. The states argue that the Constitution mandates approval from a majority of state Houses of Assembly, a step they claim was not taken.

The states involved include Ondo, Edo, Oyo, Ogun, Nasarawa, Kebbi, and others. They assert that any law conflicting with the Constitution is invalid and cannot be enforced in states that did not consent.
